Uri attack: Jaish-e-Muhammad suspects in hand, evidence shown to envoy

India’s efforts to hold Pakistan accountable for the attack on a camp near the 12 Infantry Brigade headquarters in Uri escalated on Tuesday with Islamabad’s envoy to New Delhi, Abdul Basit, being summoned to the Ministry of External Affairs to be presented with evidence that the attack originated from territory under Pakistan’s control.

The National Investigation Agency earlier announced the arrest of two men it says “facilitated” last week’s strike which claimed the lives of 18 soldiers.

Yasin Khursheed, said to be a resident of Khiliana Kalan in Pakistan-occupied Kashmir’s Muzaffarabad, and Faisal Hussain Awan, a resident of Potha Jahangir, disclosed during interrogation that they were ordered to “facilitate infiltration of a group of four Jaish-e-Muhammad cadre who carried out the Uri army camp attack”, the Ministry of External Affairs said.

Punjab RSS leader Jagdish Gagneja passes away

Senior RSS leader Jagdish Gagneja, who was shot at in Jalandhar by unidentified assailants in August, died at a hospital in Ludhiana on Thursday morning. Gagneja, 65, breathed his last at 9.16 AM at the Hero DMC Heart Institute, Dr G S Wander, Director of the Institute, said.

Brigadier (retd) Gagneja was attacked by bike-borne assailants on August 6 in Jalandhar. He was rushed to the Ludhiana hospital in a critical condition the next day. After police failed to get clues in the murder of the Vice President of the Punjab unit of the Sangh, the case was handed over to the CBI recently.

SC notice to Mohammad Shahabuddin on plea seeking cancellation of bail

The Supreme Court on Monday issued a notice to criminal-turned-politician Mohammad Shahabuddin on a plea challenging grant of bail to him in a murder case.

The bench of Justice Pinaki Chandra Ghose and Justice Amitava Roy also issued notice on a plea seeking stay of the Patna High Court order granting bail to Shahabuddin.

While asking the Bihar government to serve notice on him, the bench directed the next hearing on the matter for the coming Monday, September 26.


The court order came on a plea by Chandrakeshwar Prasad, whose three sons were allegedly killed by a henchman of Shahabuddin, and the Bihar government challenging the High Court order granting bail.

Pakistan Army chief General Raheel Sharif meets top commanders, reviews army preparedness

Pakistan Army chief Gen Raheel Sharif on Monday met his top commanders and said the military was “watchful” towards the security imperatives of the country in the wake of “hostile narrative” by India after terrorists killed 18 Indian soldiers in Kashmir.

The Corps Commanders’ Conference – held in Rawalpindi and chaired by Gen Sharif – reviewed external and internal security situation and operational preparedness of the army, the army said in a statement.

“Taking note of a hostile narrative being propagated by India, COAS (Gen Sharif) said that we are fully cognizant and closely watching the latest happenings in the region and their impact on the security of Pakistan,” the statement said.

“Armed forces of Pakistan are fully prepared to respond to entire spectrum of direct and indirect threat,” he said, expressing his satisfaction over operational preparedness of the army.

Brahamdagh Bugti to appeal for political asylum in India

Baloch Republican Party (BRP) founder Brahamdagh Bugti on Monday announced that he would appeal for a political asylum in India.

Bugti said that the decision was taken in his party's central committee meeting.


"The meeting of our central committee ended today. And in the meeting the members of the central committee have decided with majority that I will appeal for a political asylum in India," Bugti told ANI.

Bugti said that the he would seek an appointment with the Indian embassy in Geneva.

AAP ministers Satyendar Jain and Kapil Mishra on Saturday went to meet Lt Governor Najeeb Jung at his office following his fax to Deputy CM Manish Sisodia to return from Finland, but the meeting did not materialise as Jung was not in his office, triggering a fresh spat between the two sides.

“It appears he is not in a mood to work today,” Mishra said taking a jibe at Jung. But the LG office retorted that it was operational on all seven days of the week and the ministers did not seek prior appointment even as it accused the AAP government of politicising the issue when the city was grappling with a health crisis.

Fourth attack on Israelis in uptick in violence

 A Palestinian stabbed an Israeli soldier on Saturday in the flashpoint West Bank city of Hebron before he was shot dead, the army said, in the fourth attack on Israelis in less than 24 hours.

A military statement said the attacker drew a knife during a routine security check in Hebron's Tel Rumeida neighbourhood, wounding the soldier.

"In response to the immediate threat, forces at the scene shot the assailant, resulting in his death," the statement said.

Congress loses Arunachal two months after it got it, 43 of 44 MLAs defect

WFI refers Narsingh dope case to CBI

The Wrestling Federation of India (WFI) on Friday referred the alleged dope case of grappler Narsingh Yadav to the Central Bureau of Investigation (CBI) for a detailed probe.

WFI President Brijbhushan Sharan Singh, who met officials at the Prime Minister's Office, requested that the probe be carried out by the country's premier investigating agency.


"The President, Wrestling Federation of India, met PMO after arriving from Rio (de Janeiro) and requested the case of Narsingh Yadav may please be forwarded to CBI for further investigation," a WFI statement read.

"Today, Brijbhushan Sharan Singh, MP, President, WFI, has confirmed that the case of Narsingh Yadav has been referred to CBI for further investigation," the statement added.

US rejects Hafiz Saeed's remarks charging India, America against CPEC

The United States has completely denied the statement made by Hafiz Saeed, founder of the banned terrorist group Lashkar-e-taiba(LeT), that the new pact between Indiaand America against the ChinaPakistanEconomic Corridor (CPEC), is "against the Muslim Worldand bulwark Pakistan".

Karnataka Chief Minister Siddaramaiah has convened an all-party meeting  in the state on Tuesday evening to decide the government’s course of action in the wake of the Supreme Court directing Karnataka to release 15,000 cusecs of water over the next 10 days from Cauvery to Tamil Nadu.

The Supreme Court’s orders came in the wake of a plea by Tamil Nadu government against Karnataka’s alleged violation of orders of the Cauvery River Water Disputes Tribunal for release of water for agriculture in the Cauvery basin in Tamil Nadu.

Karnataka has been arguing that it does not have sufficient water in its reservoirs in the Cauvery basin to service the agricultural requirements of both Karnataka and Tamil Nadu on account of insufficient rainfall during the monsoon.


The state has claimed it has only 51 TMC of water in its reservoirs in the Cauvery basin which can service only the drinking water needs of south Karnataka.

Siddaramaiah is holding consultations with legal experts and opposition parties on Tuesday even as a bandh has been organised by farmers and pro-Karnataka organisations in the Mandya region of the state where the agricultural and drinking water requirements are met by the Cauvery river.

“We are yet to receive a copy of the Supreme Court order. Once we examine it we will consult all parties and take a decision,” Siddaramaiah said on Monday.

The head of the Cauvery water agitation group in Karnataka the veteran G Madegowda has threatened serious consequences if the Congress government releases water at the cost of farmers in the Mandya region. Madegowda has demanded the removal of the head of Karnataka’s legal panel in the Supreme Court, Fali S Nariman, for failing to effectively present the case of the state.

With the emotive Cauvery issue resulting in violence and farmer suicides in the past, the state government has deployed additional police forces in the Mandya region – especially on the Bengaluru-Mysore highway and at the Krishna Raja Sagar reservoir near Mysore.

The Mandya district collector has banned tourist activity at the Brindavan Gardens next to the KRS reservoir for four days till September 9 on account of the Cauvery agitation.

The state transport corporation cancelled bus services going via Mandya on the Bengaluru-Mysore route on Tuesday.

Modi raises black money, tax evasion at G20 (Economy Roundup)

Indian Prime Minister NarendraModion Monday raised the issues of black money and tax evasion at the G20 Summit here, urging member countries to act against financial corruption.

On the second day of the Summit here, Modi said: "Fighting corruption, black money and tax evasion were central to effective financial governance."

Modi urged the grouping to show full commitment to action against financial corruption and said effective financial governance required action against the corrupt and elimination of safe havens for economic offenders.

"We need to act to eliminate safe havens for economic offenders, track down and unconditionally extradite money launderers and break down the web of complex international regulations and excessive banking secrecy that hide the corrupt and their deeds," Modi said in his address at the G20.

Representing 85 per cent of the world's GDP, the G20 is composed of Argentina, Australia, Brazil, Canada, China, France, Germany, India, Indonesia, Italy, Japan, Mexico, Russia, Saudi Arabia, South Africa, South Korea, Turkey, the UK, the US and the European Union.

Making his intervention in the discussion on 'More Effective and Efficient Global Economic and Financial Governance at the G-20 summit', Modi called for further strengthening the global financial safety net.

"We need a regular dialogue between the IMF, Regional Financial Arrangements and Bilateral Swap Arrangements. Important mechanisms like financial stability board should stick to their core mandate."

On tax evasion, Modi reiterated India's support for Base Erosion and Profit Shifting (BEPS) recommendations and calls on countries to commit to the timeline of 2017-18.

"PM professes India's support for BEPS recommendations and calls on countries to commit to the timeline of 2017-18," External Affairs Ministry spokesperson Vikas Swarup tweeted citing the Prime Minister.

India had earlier declared its commitment to implementing BEPS, which advocates avoidance of stateless income and plugging loopholes by which entities avoid tax in operating across borders.

The Paris-based think-tank of developed nations, the Organisation for Economic Cooperation and Development's (OECD) Base Erosion and Profit Sharing deliverables advocate consistent tax rules throughout the world.

In this connection, a Central Board of Direct Taxes (CBDT) committee on taxation of e-commerce had earlier this year suggested an "Equalization Levy" of between 6-8 percent for business-to-business digital transactions.

This recommendation had formed the basis of Finance Minister Arun Jaitley's Budget 2016-17 proposal for an equalization levy of 6 percent in order to tax income accruing to foreign e-commerce companies from India.

The committee has suggested that the levy be imposed on the amount paid to a non-resident by an Indian resident for specified digital services.

The specified services would include online advertising or any services, rights or use of software for online advertising, including advertising on radio and TV, designing, hosting or maintenance of websites, digital space for website, e-mails, blogs, facility for online sale of goods or services or collecting online payments.

It would also include use or right to use or download online music, online movies, online games and online software applications accessed or downloaded through the Internet or telecommunication networks.

AAP minister Sandeep Kumar arrested on rape charge, suspended from party

Capping a day of dramatic developments, sacked Delhi Minister Sandeep Kumar was arrested on Saturday night on rape and other charges hours after he surrendered before police following a complaint by a woman, who purportedly figured in an “objectionable” CD with him.

“Kumar was arrested on rape and other charges as per details that emerged during preliminary investigation,” DCP (Outer Delhi) Vikramjeet Singh told PTI.

36-year-old Kumar, who was suspended by AAP, will be produced in a court on Sunday.


The 40-year-old woman’s statement was recorded before a magistrate under Section 164 of CrPC.

After recording statement of the woman and Kumar, he was booked on charges of rape, transmission of material containing sexually explicit act and taking illegal gratification.

In her complaint, the woman alleged that around 11 months ago, she was raped by Kumar when she had gone to his office in Outer Delhi’s Sultanpuri seeking help to obtain a ration card.

She alleged that Kumar had offered her a spiked drink and, when she fell unconscious, she was taken to his house adjacent to the office and raped. The woman alleged that Kumar had told her that he will get a ration card for her and also ensure jobs for her children.

Kumar was booked under IPC sections 376 (rape), 328 (Causing hurt by means of poison with intent to commit an offence), 67A of the IT Act (punishment for publishing or transmitting of material containing sexually explicit act) and Section 7 of the Prevention of Corruption Act (Public servant taking gratification other than legal remuneration for an official act), said a senior police official.

Earlier in the day, AAP’s Political Affairs Committee suspended the first-time MLA from the party and referred the matter to its disciplinary committee.

Kumar was removed from the council of ministers on August 31 by Chief Minister Arvind Kejriwal after the CD purportedly showing him in compromising position with the woman surfaced.

The MLA from Sultanpur Majra had surrendered before the investigators at the office of DCP (Outer) in Pitampura where his statement was recorded, senior police officials said.

Kejriwal had tweeted that if the allegations were found to be true, Kumar should be given “exemplary punishment”.

“If woman’s allegations are correct, this is v serious. Strongest exemplary punishment shud be given to Sandeep,” Kejriwal who is in Rome to attend Mother Teresa’s canonisation tweeted.

Rape fallout: West Bengal Govt puts 5,000 applications for Ola permits on hold, wants data on drivers

Adhikari said Ola operators will be required to submit data of all drivers working under them.

Speaking to The Indian Express, Adhikari said, “We have clearly given Ola cab operators a condition. They have to submit to us data of all the drivers on board with them. All the drivers must have a background clearance certificate issued by the local police station. If not, we might cancel the license of Ola in the near future.”

He further added that 5,000 proposals from Ola requesting permits were put on hold. “We will not issue any new permit to Ola until they satisfy us by fulfilling the criteria set by the transport department.”

Ola had received a temporary license to operate in Bengal around June. The state transport department issued a showcause notice to Ola post the incident.

A senior transport department official said, “The authentication of residential addresses, educational and criminal records is typically outsourced to third-party background verification companies by cab operators in India. Outside India, every taxi company requires drug screening and live-scan fingerprinting at the local police department before issuing a taxi driver permit.”

A source from a cab service provider in Kolkata said that the agencies usually take between seven and 10 days to give a report, and charge between Rs 2,000 to Rs 3,000 per candidate.

“It is the responsibility of the car owner as well to cross-check the background of the driver,” a police officer said. In the recent case, a minor girl was abducted, gangraped and then was murdered in an Ola cab that belonged to a different man, who in turn had hired Guddu Singh to drive it. “Getting a good driver is the biggest challenge, since most of them have migrated from smaller towns, and do not have a fixed residential address. In most cases, they do not have any proof of residence as mandated by authorities to issue a Police Clearance Certificate. It is difficult to establish all other addresses a person has resided in the country over previous years in the absence of residential proof or documentation. One has to rely on the applicant to disclose the addresses in order to check criminal records in all those police stations across the country,” said Mahendra Kumar Singh, a cab owner.

The system in which background checks have become just a formality needs to be changed, transport officials said, adding that it is important to carefully monitor, assess and report the methodology behind background checks to ensure there are no gaps.

“It looks like all these firms want someone to shift the blame in case of an unfortunate incident. I am shocked that police couldn’t stop a moving car where a girl was being raped. I was even more shocked to know that Guddu Singh, the accused, is a known criminal and yet managed to get a clearance certificate. This shows how things work here,” said Nidhi Shaw, who no longer uses app-based cab services after being harassed by a driver.

Guddu was arrested in a robbery case in 2013, and had been driving cabs for Ola since his release around two months ago.

A tea seller at Khidderpore, where Guddu had been staying, said, “He is drunk most of the time. He had a bad image in the locality since he is often found passing lewd comments on girls. He has been involved in many small crimes since he was 11. I don’t know much, but he was also in jail for some time.”

Collegium meetings should be recorded, Supreme Court judge tells Chief Justice of India

A letter by a senior Supreme Court judge, who is also a member of the collegium, has left Chief Justice of India T S Thakur perplexed. Justice J Chelameswar has sought that the Supreme Court collegium — that comprises the five most senior judges — record minutes of the confidential meetings held to discuss appointments and transfers of judges.

Justice Chelameswar, incidentally, was the lone judge who had favoured doing away with the collegium system when a five-judge Constitution Bench, in October 2015, struck down an amendment to validate the National Judicial Appointments Commission (NJAC) Act.

Justice Chelameswar, as first reported by The New Indian Express, has written to the CJI, apprising the latter of his decision not to attend future meetings of the collegium. He has not, however, recused from the collegium. Justice Chelameswar has clarified that the recommendations being made by the other four judges, including the CJI, should come to him “by circulation”. This effectively means that the other four judges should put their recommendations in writing and then send it to Justice Chelameswar for his views.

If the CJI and the other three judges accept it, this would result in formally recording the minutes of the collegium. The judge’s communication, it is learnt, has questioned ambiguities and lack of transparency in the decision-making process of appointment and transfer of judges.

Justice Chelameswar’s letter resulted in the collegium meeting, scheduled for Wednesday to discuss the revised Memorandum of Procedure (MoP), being called off. It is learnt that the other judges of the collegium are set to deliberate on the future course of action.

Last year, when a Constitution Bench gave a 4-1 verdict striking down the NJAC, differed with the other judges, underlining that the judiciary’s power over appointments was “not the only means for the establishment of an independent and efficient judiciary”. He had called the proceedings of the collegium “absolutely opaque and inaccessible both to public and history, barring occasional leaks”. Justice Chelameswar will retire in June 2018.

His disagreement with the over 20-year-old procedure of picking up judges has come at a time when the government is at loggerheads with the CJI and the collegium over finalising the MoP. Notably, one of the chief issues of discord between the two pertains to the government’s demand that the collegium must record minutes of its meetings and underline dissent by any judge while making recommendations. This clause has been rejected by the collegium.

Sources close to Justice Chelameswar said the judge has decided, for now, not to make public the contents of the three-page letter written to the CJI. “In the interest of the institution and to maintain institutional correctitude, the judge is not going to make the content public at this stage. However, if the situation so demands, he may consider doing so in future,” sources said.
